Duke's Last Stand
Duke, the brown-nosed pit bull who has been pining in a muncipal shelter in Suffolk County for more than three years while his case winds its way through the court system, gets his final chance at justice.
On Fri., Oct. 26, Duke's case will be heard by the Appellate Division in Brooklyn.
Duke's advocates are encouraged to write polite letters in support of Duke, as well as to gather in support at the court.
Date of Appellate hearing : Friday, October 26. Supporters are gathering at 9 a.m.

I wish the best for the 26th, we've been hearing about this for a long time now... hopefully duke can go home... keeping the faith for all...
did anyone hear about the dogs and cats that were thrown from a highway, I think it was about 80 or more, most dead... this is what society has come to, what a shame! Hope you are all doing well :)

Hey Chrissy we will be at the court on the 26th to support Duke for his last stand, keep the fingers crossed and get those letters out.
If anyome sends one please simply state that the law was not in effect back when Duke was accused and he should be set free. if they can save Vicks dogs from death surely Duke has to be spared he is not a fighter nor agressive.
I saw the articles of what happened in PR and I sent emails to the mayor already boycotting PR,and telling them they should be ashamed of themselves. 50 dogs and 6 survived.
They are having a march there this Saturday

I sent a letter in support of Duke and it was returned to me today saying that they can't accept letters from outsiders. Did this happen to anyone else since this is the first time I had this happen? This baby needs to go home to his family. I am so disgusted with how animals are treated in places like PR. I never had a desire to visit there and now I definitely won't.

No Susan! How can that be? I also mailed 2 letters today, one from me and one from my daughter.
I've sent many letters in the past and not one came back...This is not good. Duke needs all the support he can get. What difference is it where we live, its a Pitbull issue and this boy is a sweet, loving dog and needs to go home.

Valerie called me today, Thursday at 3:30 my time, on her way to work. I wasn't home but she left a message...
Dante is not a candidate for the scope they talked about yesterday. I guess he's not large or doesn't weigh enough. Now the vet is talking MRI again. They keep saying if Dante has to have a shunt, its a very serious operation and there is a chance he won't make it through the surgery...Val's words were, "and I'm not ready to lose my boy" and then she started crying..so did I.
They are going to setup an MRI for the boy in Redwood City, California, just across the bay from where Val lives...After the scan, she'll know just how serious his kidney problem is.
PLEASE people, continue to pray for the little guy and light candles....He needs our help.....Pray that whatever is wrong can

The letter I received with my returned Duke letter stated that materials received from people who are not parties to the appeal won't be considered, just determined upon the record and briefs submitted by the parties. Needless to say, I am very upset that my letter is back with me and not able to help sweet Duke. I hope the court is flooded with so many letters that they won't be able to ignore it.
My thoughts and prayers are with Val and Dante. It is so hard when a beloved pet is sick. They can't tell you what is wrong and the waiting for an answer is hard.

Thanks Susan, it just doesn't seem right that we can't send letters of support for Duke from all over. I thought that was what they were told by Dukes's attorney........

I sent a letter almost 2 weeks ago and nothing came back, I have 3 more going today. What gives we have been on this for over a year and have met Duke I would say we are part of the parties and are part of this case after all we have done. Oh well maybe I will forget to put a return address on it.

Debbie, this is the first time a letter was sent back to me and I have written other letters on behalf of Duke. I'm going to send another one. You're right. The courts work for us and our voices must be heard.

I received a letter from the Appellate Division also, saying the same thing. Except they included in the envelope someone else's letter instead of mine. Debbie, the signer is R Gully. I cannot believe the courts are doing this. Just the manpower and expense of returning the letters will be fairly high. The letter was date stamped as received, so the courts do know that there is a lot of support for Duke.
I think Duke's being at his own hearing is a fine idea. Here's hoping the judge is an animal person and can see what a fine dog Duke is and always has been. GO DUKE!!!!!!

Perhaps we can send letters in care of Denise and/or Duke's lawyer and they can present it to the court for us. Surely the courts cannot ignore letters brought forward by the direct parties involve.

OPHELIA - I think you have an EXCELLENT idea by giving these to the attorneys for Duke, and asking them to present them. I also think we must be "very careful" not to overpower the Courthouse with mail if they are sending these back. We do not want to anger the Judge or the Court.
If Duke cannot be there, I think the children of Denise would speak more freely of the safety of this dog and their love. I hope they as Duke's family will be there and included in the Hearing.

thanks everyone for writing for duke. i've informed the attorney that the letters are coming back and we'll see if she can do anything about that...
tjill unfortunately the first thing the attorney tried was to have duke there and she got a big NO from the court.
kathleen unfortunately noone will be speaking except the attorney. as it has been explained to me, this it not a trial. this is the appellate division. this is it - nothing after this...
an appeal was put in about the wrong law being applied and the courts accepted hearing about it. that's what friday will be. at this stage of this horrible game, nothing new can be introduced, no testimony will be heard by anyone, nothing... it's just the attorney having no more than 15 minutes to present her case of the law and the panel of judges listening and deciding if the wrong law was applied.
having said that i hope i didn't make anyone too sad. the wrong law WAS in fact applied so if the judges do their job (which is follow the law...) they HAVE to overturn the case...
lots of prayers for duke!!! the boy deserves to live...

This is horrible. I wrote for Duke too. What if we send letters with local addresses? Maybe we can email out letters to the locals and they can place them in with their letters? We can just sign our name with no address. It could be like a petition.

What do you people not understand? This is an appellate court hearing arguing that the proper law was not applied. That's it. Totally based on the facts already presented only. Bombarding the judge with your crazy letters is undermining Duke's case. Just mind your own business.
Maybe the Menendez's can summon all their brain power show up on time at the correct court for this one. They brought this all on themselves.

Who is D anyway? Was it someone who posted to the blog at other times? How did they know about the blog or maybe they just read it and did not post?
Just wondering as I don't remember anyone using just D. So they are now positive then this was Vivi?
I do keep up with the other news and pray and send positive thoughts for all the people and dogs who's plights cross this blog. I know what the people with dear little Madison are going through too as I have had a family member suffer a severe brain injury and the road back is painful and hard with setacks accompanying the gains. This was an older person who never progressed very far, but Madison has youth on her side. If anything being so young is in her favor.
But Vivi also holds such a special place. To think this little whippet is still out there is right up there with all of the most heartbreaking things posted here.
Vivi please show your face again and come home.

Will you be there Friday to show support, we will. Please do not be bashing his family they do not need it right now, and use your real name it is getting childish. If it was your dog we would support you, not sling mud in your face, what's done is done and we are trying to save his life. Say a prayer for him.

Interesting article about Hiliary this morning on Fox News' website. Seems poor old "Socks," who she pretended to love so much in the White House, was dumped upon leaving the White House.

ROOOBY, I'm with you. I can't stop thinking about Vivi and hope the new postings in that area will bring results very soon. We need this miracle.
I hope Duke will finally be reunited with his family after Friday's court date. After Michael Vick, one would think that compassion would be the rule of the day. I don't think the court would like people to see similarities between them and Vick. What Duke has been through is cruel for him and his family. They should be the ones protected from the neighbor from below not the other way around.

This is the day I have been getting emotional over for the past few weeks. It's a day I should be happy about but it's more a bittersweet day. Today, my twins Madison and Jason turned 5 years old. I give thanks to God that I AM celebrating two birthdays and not just one. Madison is here and she is making progress and God is being glorified through every step she makes in her journey. However, the older she gets the harder it is for me to see her at the level of a baby. It's hard to see her physically look like a beautiful little 5 year old. But, to never hear words come out of her mouth or even that sassy little look she'd give me is heartbreaking. I am not giving up....far from it. I still believe that she will talk and walk. But, it's the milestones like this that hurt. It's those milestones that her twin is hitting and she is not that hurt. Enough of that...I AM happy that Madison is here with us and that we could plant kisses on her all day long. I am happy that she got to taste frosting off of my finger and I am happy that I got to see her smile today.
A very good friend of mine shared a quote that is very appropriate. I need to post this one around my house because it's a good reminder.
"Don't mistake God's patience with His final answer."
Very good point! I definitely need to put that one on my refrigerator. Anyway, things are moving right along. I will post more pictures in the next few days so be on the look out for them! Until next time...

I don't remember who told me this but I was told that Honi and I believe her sister were going to take a boat out in the marshes and look for Vivi after the toll booth sighting. Don't know if this was ever done. It's true that because of Vivi other dogs have been helped but IMO finding Vivi is what counts most. I hope D was questioned thoroughly and I'd like to know what the outcome was. As Rosa says Viva La Vivi---and please don't forget Vivi is the reason we all came together.

I do think "D" was questioned and she is credible. Then there was one more possible sighting, but from before D reported, by someone else, in roughly the same area, upon interviewing someone else local. I do not know the outcome of the boat trip Honi was supposed to go on but I have to assume if they went and saw Vivi we would know that. I know two people at least are still trying to find a camera location, and actively, but very few people are still able to do the legwork, which is considerable. Honi said she also called the toll booth people trying to get them to look at the tapes from September 25 (I think that's the date and I am sure they know the exact time- and they have D's phone number so she can supply the time if not). Last I heard they had not done this. It's as good a sighting as we can hope for at this point and in a logical location. Others faxed and mailed hundreds of places nearby to keep her in the mind of people who may have forgotten. A core group has not given up. That's not much to report, but it is something.

Is there a street address nearby, or two intersections to pinpoint near where Vivi was seen so someone could call up some maps or satellite views. This would help to get some names of businesses and people nearby from the internet to possibly contact and distribute pictures of Vivi.

I was told that Honi and someone had gone out on the boat, but nothing found. This did happen from what I was told.
I had also heard about the camera location being looked for as well. And I do know that D contacted the proper people to help.
I hesitated to post this since I was told this privately, but I see Karen did mention it above. Things are definitely being done, but it is my understanding they are keeping the details quiet just in case. I got the impression they do feel these sightings are very credible, and they are trying to avoid a lot of people going to this area and possibly scaring her away by keeping the information quiet and the people limited in that area if possible.
I think this is probably a very wise approach. Believe me, they ARE trying from what I was told.

kathleen I knew about the boat a while ago (see my post above Karen's).Never knew it was private info and who decides what's private??? So many Greyhounds have been found using searchers and putting out info so I don't see why it's necessary to be secretive. As far as scaring Vivi away---it's been almost TWO years and where have we gotten using" The keep it between us strategy." Like I said months ago,"The definition of insanity is doing the same thing over and over and expecting different results."

Finding Vivi and getting her home is the number one priority for all of us. She is why we all have become animal crusaders and now we have to accomplish the primary goal of reuniting her with her family.

Thanks Susan. I agree. Vivi does need to be the primary focus, but I (for one) am not in New York to help with this. I sure wish I were. Bloodhound Tinkerbell and I would be going out looking I'm sure. If Vivi had chicken, you can bet Tinkerbell would find her!

Kathleen, I too wish I was in New York to help our wonderful Team Vivi. I can only imagine how frustating and difficult it is for them.
I just saw the update on the California fires and hope all you Calif. girls are OK. They also said the animal shelters have been moved and people are camping outside the stadium because pets aren't allowed inside. My heart goes out to all of them and hope these fires will be extinquished soon. Any news on the San Diego Zoo? So many people losing their homes. If anyone set one of these, may they be apprehended quickly and jailed.

Kathleen: I was not attacking you. I was attacking the people who put you in the position to be secretive. Sometimes you have to read between the lines. Try and understand that in spite of all the tremendous efforts of the NY gals and the rest of us (contributions, mailing, faxes etc.) we are no closer to finding Vivi than we were Feb.15 2006!!!! Doesn't that tell you something?? This game plan of secrecy doesn't work. I haven't posted in a while but my reason for posting yesterday was to try and refocus on Vivi.Maybe I haven't accomplished that, but at least I've given it my best shot.

Are there secrets being withheld from the bloggers? I do not know. All I know is that it is so frustrating to have these possible leads pop up and then Vivi disappears again off the map for weeks to months at a time. I think a miracle is going to be needed in order to ever catch her. JMHO.

Thanks, Kathleen. I did go on the San Diego Zoo website and read about all the preparations they had in place for the animals and how the land was laid out so it is well irrigated and about the fire proof building to house the ones who need it. Many people there have been working to keep pets safe, including the 2400 horses put in a safe field and that the wild horse herd was moved. My thoughts and prayers are with everyone there who have lost their homes and the families who lost loved ones.
We need some good news. May the judge show compassion and let sweet Duke go home to his family. Like you Rooooby, I wrote letters before for Duke and I hope they will help him tomorrow.

Marnie, I had a similar experience with my little beagle, Sam. He also had a tumor that burst. He had surgery also, and he pulled through the surgery, but passed away a few hours later. It is devastating. I am praying for you sweetheart. I know exactly how it feels. I love you, Betty

Susan, thank you for asking about the pup in California. Our dear Darlene was able to get a whole network of people working on this. There are actually two who will be coming to Ohio for adoption. Michael and I are adopting the shepx and Tammy in Ohio is adopting a long haired chi that was scheduled for euthanasia. A lady named Marilyn tried to get them out of the shelters yesterday, but was unable to with the fires. The babies are safe and the shelter knows we are coming for them. We have to get flights out of California to get them home. Cheryl and Katrina are working on this as soon as the babies are pulled from the shelters.
Keep them in your prayers. Marilyn's dog got sick and was vomiting. She said it was like 100 degrees there. Keep her dog in your prayers too. I am not sure if she will be able to get to the shelters today, but she is going to try. Love you guys, betty

MICHAEL - Thanks for the update. I'm a huge, huge animal lover and can't bear the thought of any of them having to pass away before their time is up.
I live in the Chicagoland area, so there was no way I could retrieve the dog - but wanted to ensure that it got somewhere safe.
I've been praying for every single creature involved in the fires - from the firemen to the people to the domestic pets AND wild animals. I hope that they catch the vicious people who did this and charge them with first-degree murder.

I see Rooby posted what happened in court, here is a little intake as to how it went. There was alot of media coverage and 2 news channels already had it on as did a radio station. NY Times, Channel 7 eyewitness news, news12 Long Island, NY Post, Channel 11 news which is WB11, Fox news and a bunch of reporters were there. Dukes case was called fast, they skipped cases 4, 5 and 6. The 2 cases before us was a chikd molestion and murder case, imagine the Judges getting a dog case right after.
They asked Amy questions which she answered and went into the law that did not exist back then, one Judge asked what her wish list was and she laid out what she wanted to not euthanixe Dke, one Judge asked if he went home will he be contained because if he gets out again he will have no case this time. The way he worded it was almost as if he was saying Duke will be freed. Amy the lawyer did a great job, everyone was excited when we left the court, as we all left almost the whle court emptied out and I made sure to turn and look at the Judges as we walked out the door. I liked the look on one of the Judges face. Amy gave a thumbs up as did everyone else. They all feel this case will be decided quick. Keep you fingers crossed. We feel good.

Please pray for Marilyn. She is trying so hard to get Misty Rose (Shepx) and Lucky (little Chi) out of the shelters, but she is suffering from dizziness. She is working so hard trying to get there, but she isn't feeling well at all. These fires are having a terrible effect on every living being. They neeed prayers.
Praise God things went well for Duke!! I can't get the little guy's face out of my mind.

Kay we are all hoping the verdict is good, the Judges brought up about Dukes prior so called incident, Amy answered back saying how can you identify a dog in a fight in the dark, she said his own witnesses could not identify the dog in question. The best defense is the Vicious Dog on Dog law was not in effect back in 2003, the law went into effect in 2004. The Judges asked if there was a contained area in the yard for the dog, and Amy also stated that Denise has another dog which in 4 years has not had a single complaint about her. Denise should know the decision in a few weeks it could take 2 weeks to 4 months, we are hoping they decide sooner.
Thanks to everyone for your support. This has been a tough couple of months over here and I hope this is the last hurdle for this boy, they also had the news at the Shelter, one reporter was crouching down rubbing Duke while he was eating a bully stick, I'd say any agressive dog would have bit the person, not Duke he kept on chewing his treat.

Just back from my pick-up of a border collie in Brinkley, AR. Oh ladies, he is such a LOVE. Absolutely adorable, and so well-behaved at only 8 weeks. He is black and white, with black ears and a black patch over one of his eyes, and white with little black freckles over the other side of his face.
Wish I had a larger house and a BIGGER budget - I know a border collie that would be coming to live with us. Oh my, wouldn't little Missy (S)tinkerbell get her JRT target tail "in a curl" then!
Marnie, sure you don't want to adopt a border collie. Tubbs would love you I know! This picture does not do this adorable baby justice at all....

KAY - Darlene was the one who forwarded me an e-mail asking for help in Tennessee for the staffie pups I posted about. I was going to help with these, but that was cancelled for some reason. Then this cute little border collie needed help.
Darlene was telling me how wonderful it was to be a part of helping these babies go to their new homes. She was sure right.
It has been very rainy here and today it was like God gave me this WONDERFUL sunshine and an even better WONDERFUL cool wind to put my windows down and enjoy the trip with Tubbs. Believe me, the pleasure was all mine. It was an incredible experience.
I thought how lucky this little boy was to be safe and happy when he came so close to being euthanized. What a terrible loss it would have been to some lucky person who will have him to love so much very soon.
Thanks Darlene for suggesting this to me. It was a wonderful experience indeed. Today was a glorious and happy day for me because of Tubbs.

KATHLEENSssssssss...You do not want to adopt a Border, nor do I...They are very, very active and need lots of exercise and things to keep them busy or you'll have a nut case on your hands...Stick with what you have and just keep trying to find a home for the Border..If you
want info on Borders, AXE Karen Stinnetttttttt, she's got 2 and they keep her busy and she's at least 50 years younger than you or I....heh heh..
Keep up the rescue work, but DO NOT ADOPT A BORDER, DON'T EVEN THINK ABOUT IT...DANGER, DANGER...HEHEHEHEH

Yes, Border Collies can keep you on the go. One of my neighbors has two, I believe. When they let them out. It's zip and they are gone running. They are across the bridge and are running down our street before the owners can get out of the yard to try and catch them.
And yes, I've heard a couple of stories about Karen Stinnett's doggies. They are adorable but very active.

The two puppies I have are part border collie and they are always active. I am always laughing at what they do. I have to be very careful when I am in the yard with them as they will knock me down when they get to running and I don't get out of the way. But I still love them very much.

I just posted a comment on Duke. Some of the comments were disgusting. You never know what things are lurking around these articles. They certainly aren't human. The video just about did me in. What a sweet boy Duke is. Praying the judge gives this family their beloved dog back.

ROOOBY - Thanks for the warning. I know what you mean. A friend of mine in Memphis raises and shows border collies. I have seen hers at work. Even her husband says he gets "sick and tired of being herded himself."
Tubbs is now in the foster home of Edith with the West TN Border Collie Rescue group. I just picked him up in Brinkley, AR and brought him to Memphis to these nice ladies who rescued him.
Don't worry, FULL HOUSE at my residence in Memphis, TN. The three dogs and big cat are ALL I can handle for sure. I love them all, but no more room at this Inn. Transporting a cute doggie is kind of like having grandchildren. You can love on them, spoil them, and then "send them home to their mother (hee, hee)!"
SUSAN - Glad you enjoyed the pictures. I wish I had a better one of Tubbs. He is the prettiest little fella I have seen in a long time.

Karen that is so funny. I have a Tibetian Spaniel that follows the arrow of the weather man. She sets there and her head turns every which way the arrow goes. At least she is quiet while she is doing this.

Ha, me too. My last camcorder was about the size of a cinderblock, but I do have lots of stills, including some TV herding- I'll try to find them to send. Also my digital camera will take little short film clips and my agility teacher records them sometimes so I do have a few of them.

The city council passed the ordinance banning pit bulls at their meeting
last night. The details of same are set forth in my previous post below.
The ordinance takes effect in THIRTY DAYS.
1. No person shall own, keep or harbor a "pit bull."
2. A "pit bull" as used in the ordinance shall mean any breed commonly
associated with the term, including American Pit Bull Terrier, American
Staffordshire Terrier, Staffordshire Bull Terrier OR any dog with the
appearance or characteristics or PARTIAL characteristics of said breeds.
3. Violators will be issued misdemeanor citations with degrees and
penalties that increase with each citation.
THERE IS NO CLAUSE THAT ADDRESSES "PIT BULLS" ALREADY LIVING IN THE CITY.
The clerk is of the belief there is NO grandfather clause.
(I BELIEVE IF PEOPLE ATTENDED THEIR CITY COUNCIL MEETINGS, THINGS LIKE THIS WOULDN'T HAPPEN..YOU HAVE TO GO TO MEETINGS TO SEE WHAT YOUR COUNCIL IS UP TO, NOT WAIT TIL IT'S TOO LATE!

Oh Rooooby, this is terrible. So many dogs will probably not be able to find homes and be PTS. Why can people not understand it is man who makes a dog vicious, not the breed.

Hi Friends.....here is today's call in strategy --- thank you for taking a few minutes to call, fax or email. One topic you may want to address is the illegal transportation of horses in double decker CATTLE trailers....one rolled over in Illinois this weekend, tragicly killing 14 horses, injuring who knows how many either physically or emotionally.
Strategy for Tuesday October 30
Unfortunately, this weekend turned out to be very sad. The devastating loss of the great 4 year old race horse George Washington. And the tragic double decker trailer accident in Illinois that took the lives of several horses that were being transported under the most inhumane conditions. Please make your calls this week in honor of George Washington and for these nameless horses that died without the love and care they so deserved. Also, for the survivors of this horrorific acccident....may they find peace and live free of fear and distress.
Remember...these calls are to gain co-sponsors and support for HR503 and S311. As difficult as it is, please concentrate on the transport of the horses to slaughter more than the conditions in Mexico. We can't let anyone who is not well informed come to the conclusion that it would be better to have the plants in this country because of the conditions in Mexico.
The only way we will win this battle is with more awareness. We now know from our poll that we have a lot of support in the senate. This is a chance to get the rest of the undecided senators on board.
Now that the plants have ceased operation in this county, we must grab this opportunity to push for legislation that will end the transport of horses to slaughter. Use this time wisely..we are at a critical point and actually have a chance to make a difference!!

NEWS FROM VALERIE RE DANTE.....
Hello Everyone,
Dante and I are home from getting his MRI. He did very well. I was able to sit in the recovery room with him while he was waking up. Poor guy, his tongue was hanging out of his mouth all dry and stuck to the chuck that they had him laying on (which was on top of a comfy bed). When he first started to wake up, he couldn’t get control of his tongue. But now we are home and he is wide awake and acting normal. He has peed which, was a big concern because the anesthesia can affect his kidney so I always feel relief after seeing that he is producing urine.
We will get the results Monday unless there is something really wrong that needs to be addressed immediately in which case the surgeon will call me either tomorrow afternoon or Thursday. I am hoping not to hear from her.
Now, it is time for me to go take a nap, with my boys of course, since I haven’t been sleeping so well and my stress radar is running in the red zone.
Thank you again for all the support. I really appreciate it. I will be writing again once I get the results and I may be looking for your opinions as well.
